“The Law 18/2014, of October 15, approving urgent measures for growth, competitiveness and efficiency (BOE Nº 252 of Friday, October 17, 2014. Section I) has brought forth a clear opportunity for the concessionaires of Spanish ports to increase the initial term of their concessions.
Link: http://www.boe.es/boe/dias/2014/10/17/pdfs/BOE-A-2014-10517.pdf The initial terms of the concessions authorized prior to the entry into force of the Royal Decree-Law 8/2014, of July 4th, regarding urgent measures for growth, competitiveness and efficiency, may be extended by the Port Authority, upon petition of the concessionaire and a favorable report by Spanish Ports Authority (Puertos del Estado), provided that the concessionaire commits to one of the obligations detailed in the Royal Decree-Law 8/2014 (SEE PAGES…. 83995-83996 of the official publication).
The MCVALNERA team, possessing ample experience in the management of concessions, is assisting Spanish concessionaires in the preparation of the documents required to achieve the extension of their concession’s term. The request for the extension of the term is quite complex, requiring a series of conditions that must be met, such as financial contributions towards infrastructure access projects, investments towards the concessions, reductions in the stowage operations tariffs, or a combination of these, which must justify the economics of the concession’s extension.
Therefore, it is necessary to design a strategy that allows for the extension and the drafting of the corresponding economic and financial reports that justify the actions. Each Port Authority will select an independent company for the supervision of the requests and their justifications.”
